Terms of Service

These Terms of Service ("Terms") govern your use of the Newcomy website and services. By engaging Newcomy, you agree to be bound by these Terms.

1. Services

Newcomy provides professional website creation, website management, ecommerce operations, website optimisation, payment integration, and advertising campaign services. All services are subject to a written or agreed service scope prior to commencement of work.

2. Pricing and Payment

All pricing is bespoke and depends on project scope. A detailed quote will be provided prior to commencement of any work. Invoices are due as per the terms stated in each service agreement. For certain ongoing agreements, a service fee based on a percentage (up to 7%) of the client's total sales may apply, as agreed in writing.

3. Intellectual Property

Upon full payment, clients receive ownership of the final deliverables, including website design and developed content specific to their project. Newcomy retains the right to use project work in its portfolio unless otherwise agreed.

4. Client Responsibilities

Clients are responsible for providing accurate business information, timely feedback, access to required platforms and accounts, and ensuring the accuracy of all content submitted for use in their project.

5. Limitation of Liability

Newcomy is not liable for any indirect, incidental, or consequential damages arising from the use of our services. Our liability is limited to the total fees paid by the client for the specific service in question.

6. Confidentiality

Both parties agree to keep confidential any proprietary or sensitive business information shared during the course of the engagement. This obligation survives the termination of the service agreement.

7. Termination

Either party may terminate a service engagement by providing written notice as specified in the service agreement. Fees for work completed up to the termination date are due and payable.

8. Governing Law

These Terms are governed by the laws of the Kingdom of Thailand. Any disputes shall be resolved in the appropriate courts of Thailand.

9. Changes to These Terms

We reserve the right to update these Terms at any time. Continued use of our services following any changes constitutes your acceptance of the updated Terms.
